Diamond Girlz Society Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services provided by Diamond Girlz Society (“we,” “our,” “us”). By accessing or using any part of our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

Our services are offered subject to your acceptance—without modification—of all the terms and conditions contained herein, as well as any other operating rules, policies (including, without limitation, our Privacy Policy), and procedures we may publish. We reserve the right to automatically update or upgrade our services, and these Terms will apply to any such changes.

1. Your Account

If use of our services requires you to create an account, you agree to provide accurate, complete, and current information. You are solely responsible for all activity under your account and for keeping your login credentials secure.
You may not share your account access. Any unauthorized use must be reported to us immediately. We are not liable for any loss resulting from your failure to comply with these responsibilities.

2. Responsibility of Visitors and Users

We do not review all content submitted by users and are not responsible for it. Content may:

  • Be inaccurate or offensive;

  • Infringe third-party rights;

  • Contain technical errors or harmful code.

You are responsible for your content and for ensuring your use does not harm others. Use appropriate caution, including virus protection, when engaging with any user content or external links.

3. Fees, Payment, and Renewal

a. Coaching Package Fees

All coaching services provided by Diamond Girlz Society are fee-based. You must pay in full before services begin, unless a written payment plan has been agreed upon.
 

b. Payment Plans

Payment plan options are available upon request. If you are approved for a payment plan, you agree to complete all payments by the agreed due dates. Failure to do so may result in suspension of services.
 

c. No Refund Policy

All fees are non-refundable. By purchasing a coaching package, you acknowledge and accept that there are no refunds, whether in full or in part, regardless of your satisfaction, usage, or unforeseen circumstances.

4. General Representation and Warranty

You represent and warrant that your use of our Services will be in strict accordance with these Terms:
• will comply with all applicable laws and regulations (including, without limitation, all applicable laws regarding online conduct and acceptable content, privacy, data protection, the transmission of technical data exported from the United States or the country in which you reside, the use of financial services, notification and consumer protection, unfair competition, and false advertising);
• will not use the Services for any unlawful purposes, to publish illegal content, or in furtherance of illegal activities;
• will not infringe or misappropriate the intellectual property rights of any third party;
• will not overburden our systems, as determined by us in our sole discretion;
• will not disclose sensitive personal information of others;
• will not be used to send spam or bulk unsolicited messages;
• will not interfere with, disrupt, or attack any service or network; and
• will not be used to create, distribute, or enable material that is - or that facilitates or operates in conjunction with - malware, spyware, adware, or other malicious programs or code.

5. Copyright Infringement

We respect intellectual property rights and expect users to do the same. If you believe your copyrighted work has been used improperly, please notify us at [Insert Email Address]. We will remove or disable access to infringing content when appropriate and may suspend or terminate repeat offenders' access without refund.

6. Intellectual Property

All content, trademarks, graphics, and branding associated with Diamond Girlz Society remain the exclusive property of Diamond Girlz Society. Use of any of our materials without written permission is strictly prohibited.

Using our services does not grant you any license or rights to our intellectual property.

7. Changes

We are constantly updating our Services and that means sometimes we have to change the legal terms under which our Services are offered. If we make changes that are material, we will let you know by posting on one of our blogs, or by sending you an email or other communication before the changes take effect. The notice will designate a reasonable period of time after which the new terms will take effect. If you disagree with our changes, then you should stop using our Services within the designated notice period, or once the changes become effective. Your continued use of our Services will be subject to the new terms. However, any dispute that arose before the changes shall be governed by the Terms (including the binding individual arbitration clause) that were in place when the dispute arose.

8. Jurisdiction and Applicable Law.

Except to the extent any applicable law provides otherwise, the Agreement and any access to or use of our Services will be governed by the laws of the State of Michigan, excluding its conflict of law provisions. The proper venue for any disputes arising out of or relating to the Agreement and any access to or use of our Services will be the state and federal courts located in Michigan.

9. Miscellaneous

These Terms constitute the entire agreement between you and Diamond Girlz Society regarding your use of our services. If any provision is found invalid or unenforceable, it will be modified to reflect the parties’ intent while the rest remains in effect.
 

You may not assign your rights under these Terms without our written consent. We may assign our rights at any time without condition. These Terms are binding upon and will inure to the benefit of both parties and their successors or permitted assigns.
